بازتاب های فضایی معاهدات حقوقی منطقه ای؛ مطالعه موردی: معاهدات حقوقی اتحادیه اروپا

چکیده

معاهدات منطقه ای در جهت شفاف سازی و بهینه سازی عملکرد نهادهای منطقه ای شکل می یابند و زمینه را برای هنماهنگی بهتر کشورهای منطقه ای فراهم می آورند. از طرف دیگر معاهدات منطقه ای به سیاست ها و عملکردهای نهادهای منطقه ای مشروعیت می بخشند؛ چرا که هر سیاست اتخاذی نهادهای منطقه ای توسط دولت ها به صورت دموکراتیک و داوطلبانه تایید می گردد. این معاهدات، فضای جغرافیایی مناطق مختلف را تحت تاثیر قرار می دهند و همچنین دارای یکسری بازتاب های مثبت و یکسری بازتاب های منفی نیز دارند. اتحادیه اروپا تلاش کرده است که تمامی سیاست های اعمالی خود را بر معاهدات منطقه ای استوار سازد چرا که این اتحادیه بر حاکمیت قانون بنا نهاده شده است. معاهدات اتحادیه اروپا فضای جغرافیایی منطقه را پس از جنگ جهانی دوم متحول کرده است. این مقاله بحث می کند که معاهدات اتحادیه اروپا یکسری بازتاب های مثبت و یکسری بازتاب های منفی در منطقه به همراه داشته است. بازتاب های مثبت این معاهدات عبارتند از: صلح و امنیت منطقه ای، ایجاد هویت منطقه ای جدید، ایجاد جامعه امنیتی، توسعه و کمرنگ شدن نقش مرزهای ملی. ایم مقاله همچنین این تفکر غالب که همگرایی اروپایی فقط دارای نتایج و بازتاب های مثبت بوده است را به چالش می کشد و عنوان می کند نخبگان و عموم مردم از همگرایی متنفع نمی شوند و حس در حاشیه بودن و محرومیت بخشی از مردم اروپا نیز از بازتاب های نامطلوب و منفی معاهدات منطقه ای و همگرایی حاصله از آن بوده است.

چکیده [English]

Regional treaties are set out to make regional institutions efficient and transparent, and pave the way the member states to work in harmony. From the other hand, the regional treaties legitimize every action by the regional institutions, because they are proven democratically and voluntarily by the member states. The regional treaties affect every regional space and can have some negative and positive consequences as well. The European Union is often viewed as the epitome of regional integration which has challenged most of regional studies theories. The EU has tried to base every action on treaties, because it is based on the rule of law. The EU treaties have transformed the regional space after the Second World War. This paper argues that these treaties have some positive and negative reflections on the regional space. Positive reflections of the EU treaties are as follows: regional peace and security, the establishment of a new regional identity, the establishment of a security community, development and blurring national boundaries. This paper also challenges this claim that the EU has only positive reflections and the public and the elites enjoy from the EU, equally. The sense of marginality and exclusion by some of the Europeans is also the negative reflection of the European integration.
